Foreclosure Response Priority Checklist

Check off each step as you complete it. The summary at the end is the same regardless of the order you check them in.

1. Open every piece of mail from your lender or servicer. Notice of default, notice of sale, and court papers have deadlines attached. Do not ignore them — read each one and note every date.
2. Organize your mortgage documents. Find your loan documents, monthly statements, and any letters or emails from your servicer. A single folder keeps everything in one place.
3. Contact your loan servicer. Ask about loss-mitigation options — repayment plan, forbearance, or loan modification — and get the name of the person you speak with plus a reference number.
4. Talk to a HUD-approved housing counselor. Free counselors can review your options and help with applications. Confirm any counselor is on HUD’s official list before sharing personal information.
5. Submit a complete loss-mitigation application. Send every document the servicer asks for, in the format they request, and keep copies of everything you submit.
6. Keep a written record of every contact. Date, time, who you spoke with, and what was said — for every call, letter, and email.
7. Know the timeline in your state. Foreclosure steps and notice requirements vary by state. Learn the typical sequence so you can spot when something arrives out of order.
8. Watch for scams. Anyone who demands upfront fees, tells you to stop paying your mortgage and pay them instead, or asks you to sign over your deed is a red flag.
9. Consult a licensed attorney in your state. A lawyer can review your notices, deadlines, and options. If you cannot afford one, ask about free or low-cost legal aid.
